¤ Document 1 : Après Cannes, Villeneuve-Loubet a pris à son tour un arrêté municipal interdisant la baignade en burkini.
Cet arrêté indique que « l’accès à la baignade est interdit, du 1er juillet au 31 août, à toute personne ne disposant pas d’une tenue correcte, respectueuse des bonnes mœurs et du principe de laïcité, et respectant les règles d’hygiène et de sécurité adaptées au domaine public maritime ».
Pour Lionel Luca, maire Les Républicains de la commune, il faut « éviter tout trouble à l’ordre public dans une région marquée par les attentats de Nice ». Selon lui, « la République, ce n’est pas venir à la plage habillé en affichant ses convictions religieuses, d’autant que ce sont de fausses convictions car la religion ne demande rien. »

Nul ne doit être inquiété pour ses opinions, même religieuses, pourvu que leur manifestation ne trouble pas l’ordre public établi par la Loi.
– LOI du 11 octobre 2010 interdisant la dissimulation du visage dans l’espace public
Article 1 : Nul ne peut, dans l’espace public, porter une tenue destinée à dissimuler son visage.
Article 2 : Pour l’application de l’article 1er, l’espace public est constitué des voies publiques ainsi que des lieux ouverts au public ou affectés à un service public.
2/ Le burkini dissimule t-il le visage ? Trouble t-il l’ordre public ?
¤Document 3 : Le Conseil d’État a été saisi par deux associations , le Collectif Contre l’Islamophobie et la Ligue des droit de L’Homme, afin de statuer sur l’arrêté municipal. Il a rendu sa décision le 26 août 2016 concernant l’interdiction du port du burkini à Villeneuve-Loubet
Pour le Conseil d’État cet «arrêté a porté une atteinte grave et manifestement illégale aux libertés fondamentales que sont la liberté d’aller et venir, la liberté de conscience et la liberté personnelle ». Le Conseil d’État s’est donc prononcé contre l’arrêté « anti-burkini » de Villeneuve-Loubet
